ONLINE PROSHOP
THE SCHOOL, our affiliates and suppliers advocate caution and courtesy in training
and disclaims all liability from the use of equipment purchased from THE
SCHOOL web site. Please consult a physician before beginning any new exercise
program.
Order Acceptance
Please note that there may be certain orders that we are unable to accept and
must cancel. We reserve the right, at our sole discretion, to refuse or cancel
any order for any reason. For your convenience, you will not be charged until
your payment method is authorized, the order information is verified for accuracy
and your order is shipped. Some situations that may result in your order being
canceled include limitations on quantities available for purchase, inaccuracies
or errors in product or pricing information, or problems identified by our
credit and fraud avoidance department. We may also require additional verifications
or information before accepting any order. We will contact you if all or any
portion of your order is canceled or if additional information is required
to accept your order. If your order is canceled after your credit card has
been charged, we will issue a credit to your credit card in the amount of the
charge.
Pricing or Typographical Errors
While THE SCHOOL strives to provide accurate product and pricing information,
pricing or typographical errors may occur. THE SCHOOL cannot confirm the price
of an item until after you order. In the event that an item is listed at an
incorrect price or with incorrect information due to an error in pricing or
product information, THE SCHOOL shall have the right, at our sole discretion,
to refuse or cancel any orders placed for that item. In the event that an item
is mispriced, THE SCHOOL may, at our discretion, either contact you for instructions
or cancel your order and notify you of such cancellation. Prices and availability
are subject to change without notice.
Quantity Limits & Dealer Sales
THE SCHOOL reserves the right to limit the quantity of items purchased per
person, per household or per order. These restrictions may be applicable to
orders placed by the same account, the same credit card, and also to orders
that use the same billing and/or shipping address. We will provide notification
to the customer e-mail and/or billing address provided should such limits be
applied. THE SCHOOL also reserves the right to prohibit sales to dealers.
Colors
We have made every effort to display as accurately as possible the colors of
our products that appear on the Site. However, as the actual colors you see
will depend on your monitor, we cannot guarantee that your monitor's display
of any color will be accurate.
Refunds
and Exchanges
Unless
an item is defective ALL SALES ARE FINAL. All exchange
requests for defective items purchased from THE SCHOOL web site must be brought
to THE SCHOOL
for processing. We do not accept exchanges of any item that is returned more
than 10 days after delivery.
Shipping Policy
Orders are normally processed in one business day and shipped via UPS ground.
Please allow 4 to 10 working days for UPS ground delivery depending on
your zone. THE SCHOOL may allow orders to be sent directly to your residence
or
picked up from the school. The online proshop is meant for current students
and special events only. Orders will only be shipped to the student’s
residence or THE SCHOOL for pickup.
Shipping Rates and Taxes
Shipping Rates are 7% of the order sub total with a minimum shipping charge
of $6.00. State Tax is charged and is based on THE SCHOOL’s location.
We accept
Credit Card payments only for online orders when shipping within the
United States and its territories. To pay by check please place your
order
at THE SCHOOL.
THE SCHOOL is not responsible for and cannot be held liable for any additional
fees, levies or taxes that a country may impose on a customer's order of
goods. Our shipping and handling charges does not cover this extra cost.
Certain countries
will impose additional unspecified charges that the customer will be responsible
for such as customs duty, customer V.A.T., clearance fee,
etc. To determine the additional amount (if any), please query the appropriate
regulatory agency of your country prior to placing your order as we cannot
reimburse you once shipment is made.
Heavy or Oversize Items
Some heavy or large items, which are identified as oversize in their product
descriptions, have special shipping and handling costs in addition to regular
shipping and handling charges.
Please note: Some oversize items cannot be shipped to Alaska, Hawaii, or U.S.
protectorates and territories.
Out of Stock/Back Orders
We will notify you if your request is currently out of stock. In most cases,
back orders should be received within 3–4 weeks.
Weapons
Certain types of nunchakus and other weapons cannot be shipped to Canada
nor to the states of California, Massachusetts, and New York You must check
Federal,
State and Local laws because weapons may be illegal in your area. THE SCHOOL
will not sell weapons to minors and disclaims all liability from the sale
and use of products in this online store.
Email
Confirmations
Shortly after placing your order, you will receive an email confirming that we
have received your order. Please save these email invoices for your records.
RISK OF LOSS
All items purchased from THE SCHOOL are made pursuant to a shipment contract.
This means that the risk of loss and title for such items pass to you upon
our delivery to the carrier.
INDEMNIFICATION
You agree to defend, indemnify and hold THE SCHOOL harmless from and against
any and all claims, damages, costs and expenses, including attorneys' fees,
arising from or related to your use of the Site.
TERMINATION
These terms are effective unless and until terminated by either you or THE
SCHOOL. You may terminate this Agreement at any time, provided that you discontinue
any further use of this Site. THE SCHOOL also may terminate this Agreement
at any time and may do so immediately without notice, and accordingly deny
you access to the Site, if in THE SCHOOL's sole discretion you fail to comply
with any term or provision of this Agreement. Upon any termination of the Agreement
by either you or THE SCHOOL, you must promptly destroy all materials downloaded
or otherwise obtained from this Site, as well as all copies of such materials,

GENERAL
This Agreement represents the complete agreement between the parties and supersedes
all prior agreements and representations between them. If any provision of

The failure of THE SCHOOL to act with respect to a breach of this Agreement
by you or others does not constitute a waiver and shall not limit THE SCHOOL's

shall be governed by and construed under THE SCHOOL’s State law as
such law applies to agreements between residents of that state entered into
and to be performed within THE SCHOOL’s State. Any action or proceeding
arising out of or related to this Agreement or your use of this Site must
be brought in the state or federal courts of THE SCHOOL’s state.
